1. It is understood that this agreement is binding on both parties. It can not be altered or changed unless agreed to in writing by both Jassnight Photography and the Client.

 

2. Jassnight Photography will be equipped with necessary primary and backup equipment for the photo shoot, however, if Jassnight Photography is unable to provide the work contracted with the client, to the industry standard, for any of the following reasons: accidental equipment breakage or failure of any or all equipment, weather conditions, accessibility to subjects, acts of God, social unrest, environmental interference of any kind, personal injury, illness, failure of any person to appear, or lack of cooperation by any party related to the stated event, the client will be entitled, but limited to, a full refund of all monies paid to date or is entitled to a re-shoot on a mutually agreed reschedule date.

 

3. Jassnight Photography agrees to make all efforts to capture, protect and secure all materials that have been recorded by Jassnight Photography and all materials that have been received from the client. But Jassnight Photography cannot be held liable for loss of materials due to theft, fire, flood, equipment malfunction or any acts of God. In the event of catastrophic loss or damage to one-of-a-kind recorded materials or materials provided by the client exceeds 50% of the photographed day, the client is entitled to cancel the contract and be entitled, but limited to, a full refund of any monies paid to date or a re-shoot, as defined in clause 2. Should the client elect to cancel the contract and receive a refund of the monies paid to date, Jassnight Photography is not required to turn over any remaining work/production from the contracted date.

 

4. In the unlikely event Jassnight Photography is unable to attend the contracted time of the photo shoot, Jassnight Photography agrees to work with the client to reschedule the session. If a rescheduled session cannot be agreed upon with the client, the client can request a refund of all monies paid-to-date to Jassnight Photography. The client agrees that no other legal or pursuant action may be taken against Jassnight Photography.

 

5. Unless another agreement is made, full payment of the balance due is expected after the photo session(s) are complete and before editing begins. Jassnight Photography has the right to withhold the password to the client’s gallery if payment has not yet been received.

 

6. At this time, Jassnight Photography does not offer printed photos and only produces high resolution electronic files (jpegs) which can be used by the client for printing or online posting for personal reasons only. The client may request re-edits within 6 months after delivery of their gallery. Jassnight Photography will make every attempt to satisfy the client’s wishes; however complete satisfaction of the client is not guaranteed.

 

7. The client agrees to be responsible for compliance with any rules of the facility and any applicable local, state or federal rules and regulations. Should any governmental or photo session location permits or fees be required, the client shall be responsible to obtain and pay for the same. Jassnight Photography may be necessarily limited by the guidelines or rules of the venue, photo session location, or restricted assess to location area. The client understands and agrees that Jassnight Photography will abide by such guidelines or rules and that they are outside the control of Jassnight Photography. The client agrees to not hold Jassnight Photography liable for the impact such guidelines or rules may have on the resulting photographs.

 

8. Every attempt will be made to ensure that Jassnight Photography is familiar with the client’s preferences; however, the client acknowledges that it is requesting services with knowledge of the photographer's style; that the photographer's work is constantly evolving; that photographer's services are of a unique and artistic nature; that the photos may be different from photographs taken by the photographer in the past; and that in creating the photos, the photographer shall use his personal artistic judgment to create images consistent with his personal vision of the shoot, which may be different from the client's and/or the subject's vision. Accordingly, the client acknowledges that the photos shall not be subject to rejection on the basis of taste or aesthetic criteria.

 

9. The client understands that to produce expected artwork, the photographer needs an appropriate amount of time to do so. If the client is running late, and/or the proper amount of time is not given for adequate fulfillment of the photo shoot, the photographer is not responsible for the lack of quantity or quality in photos due to time restraints.

 

10. The client understands that the photographs taken by the photographer are copy-written under Jassnight Photography and may be used by Jassnight Photography for any promotional purposes such as, but not limited to, blogging, publication on websites and in magazines, cross-promotional purposes with other companies, as well as submission for photographic competition.

 

11. The client understands that he/she is obtaining electronic photographs for personal use only. The files produced will be high resolution, un-watermarked jpeg pictures and the client may print these for personal use at any time. Jassnight Photography is not responsible for the quality of enlargements that have been taken to a non-professional and/or consumer photo lab.

 

12. The client understands that Jassnight Photography can not indefinitely keep digital photographs and any other photographic art related to this project. Jassnight Photography will preserve photographs for at least one year from the shoot date, but can not be held liable for keeping the digital media after that.By affixing their signature to the bottom of this page the client agrees to all above statements in full.
