Wedding Contract

AGREEMENT

This document comprises the entire understanding between both the Clients (“Clients”) and Jassnight Photography ("Photographer").

Confirmation: The completed, signed "Wedding Photography Contract" and the booking fee payment are both required before confirming and reserving the stated services from the Photographer.

 

Consultation: A meeting between the Clients and the Photographer typically occurs at the time of booking, but may also be conducted over the phone, Zoom or other synchronous correspondence. This meeting is an opportunity for the Clients to broadly outline requirements, identify important persons and discuss the wedding timeline. In addition, the Photographer may offer advice and provide recommendations to assist with day-of scheduling. If necessary, the Clients may wish to schedule a final consultation (about 30 days prior to the wedding date) to go over the finalized schedule and details of the day. 

 

Cooperation: The Clients and the Photographer are considered as partners and agree to fully cooperate and communicate in an effort to achieve the best possible outcome within the understanding of this contract. It is recommended that a designated assistant (such as family member or member of the wedding party) be provided to the Photographer. The assistant will help identify key individuals that are expected to be photographed. The Clients also agree to provide the Photographer with sufficient advance notice of key events, thereby providing the Photographer with adequate time to prepare for events such as the bouquet toss, cake cutting and speeches, etc. Please note that some wedding guests will decline offers to be photographed. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these persons.

 

Schedule: The collaborative efforts of the Clients and Photographer to plan and schedule photographic coverage of the day is designed to result in the production of beautiful photographs, documenting one of the most important days of your lives. Both the Clients and the Photographer are in agreement that cooperation, communication and good faith efforts to adhere to the schedule are essential to producing the best possible results. In cases where the wedding does not adhere to the schedule (whether from tardiness, forces of nature, acts of God, etc.) the Photographer will make every effort to compensate so as to make the best of the given circumstances, but cannot guarantee that the quality of the work produced would be as high as it otherwise would be due to scheduling delays, disruptions and changes.

 

Wedding Guests: Many guests will want to take their own photographs of the Clients. The Clients understand the importance of, and agree to give the Photographer precedence over wedding guests in order to fulfill the requirements of this agreement. The Photographer will not be held liable for missed photographs that are a result of interruptions and obstructions that interfere with photographing the day.

 

House Rules: Please note that photography professionals may sometimes be limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. In some situations there may be limitations on flash photography, and in others, photographers may be prohibited from working in restricted areas. In such circumstances the Clients accept that these encumbrances will restrict the quality of work produced. It is advised that the Clients make themselves aware of the rules of venues and officiants, and if necessary, negotiate for fewer and/or more favorable restrictions.

 

Copyright: The Clients recognize that the Photographer is producing works made for hire and that the copyright of all photographs is retained by the Photographer. Of course, the Clients are allowed to reproduce and make use of the photographs, provided the use is restricted to the Clients’ personal use and the personal use by the Clients’ friends and family. Prior written permission from the Photographer is required for any sale, publication or commercial use of the photographs.

 

Model Release: The Clients grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use, publish and distribute the photographs of the Clients for advertising, marketing, commercial, and any other purpose and in any manner, and to alter the photographs without restriction. The Clients hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the photographs.

 

Limit of Liability: In the event the Photographer becomes injured or is too ill and cannot supply the agreed-upon services as specified, Jassnight Photography will make all attempts to find a replacement photographer. If unsuccessful in doing so, then liability is limited to a refund of any payments received (including booking fee). The Client agrees that no other legal or pursuant action may be taken.

 

Style: Every attempt will be made to ensure that Jassnight Photography is familiar with the Clients’ preferences; however, the Clients acknowledge that it is requesting services with knowledge of the photographer's style; that the photographer's work is constantly evolving; that photographer services are of a unique and artistic nature; that the photos may be different from photographs taken by the photographer in the past; and that in creating the photos, the photographer shall use his personal artistic judgment to create quality images, which may be different from the Clients’ visions. Accordingly, the Clients acknowledge that the photos shall not be subject to rejection on the basis of taste or aesthetic criteria.

Deliverables, Timelines, and Storage: 

    Your Package: Your high-resolution photo JPEG files (RAW files are not offered) will be stored on a personal, password protected gallery for two years where you can like, share and download any or all photos for printing. (At this time, Jassnight Photography does not offer prints and is not responsible for the quality of enlargements that have been taken to a non-professional and/or consumer photo lab.) Your package also includes full editing services covering but not limited to blemish removal, skin smoothing, light balance, color enhancement, and artistic styling.

    Timelines: The Clients understand that photographing major events such as weddings necessitate a good amount of post-event labor to edit, prepare, and deliver the final photos. Jassnight Photography will make every effort to deliver the Clients’ gallery within thirty to sixty days from the date of the wedding. The client may request re-edits, within reason, up to six months after delivery of their gallery. Jassnight Photography will make every attempt to satisfy the Clients’ wishes; however complete satisfaction of the Clients is not guaranteed.

    File Safety: Jassnight Photography agrees to make all efforts to use redundant backup storage systems during and after your event to capture, protect, and prevent loss or damage to your photographs. In the unlikely event that images may be lost, stolen or destroyed for reasons in or beyond our control, liability is limited to the return of payments received for the services provided (including booking fee) or part thereof according to the percentage of images supplied.

Compensation:

 

Jassnight Photography charges by the hour for wedding events. Booking fees and down payments will be based on the agreed-upon estimate of time the photographer is needed to cover the Clients’ schedule and expectations. Payments will be required in three installments as follows:

 

    Booking Fee (30% of estimated fee): The booking fee is due upon signing this contract and is a non-refundable payment (see exceptions above) that secures your reservation for the services of the Photographer on the given date. In the event of cancellation, the booking fee will constitute liquidated damages and become forfeited by the Client.

 

    Down Payment (30% of estimated fee): Due one month before the wedding date that assures adherence to this contract and allows the Photographer to confidently plan event timeline strategies and equipment needs. It is suggested that you meet with the Photographer again around this time to firm up your timeline and communicate any changes made.

 

    Final Payment (Balance due with final tally of work hours): You will be invoiced for the final payment based on actual hours and will be due within 30 days after the wedding date and/or before your gallery is delivered. Jassnight Photography has the right to withhold the password to the Clients’ gallery if payment has not yet been received.

 

Other Expectations:

 

    Milage/Travel: Jassnight Photography operates within the Piedmont NC area for no extra travel, or milage costs. If your event is beyond this region, the Clients will be responsible for any associated mileage, meal, and hotel costs if applicable.  

 

    Meal: If the reception is part of the photographed timeline, The Clients will arrange, at their cost, for the Photographer to be provided a meal and a space to eat during the dinner. Most caterers and venues can work with you to arrange a “vendor” meal and out-of-the-way room for this.

 

    Planned area for equipment: The Photographer will need a close-by closet, or corner of each venue where additional photography equipment can be placed and easily accessible for quick access. This could be a small closet in the church vestibule, or coat closet in the reception area, for example. 

 

We have read, understood and agree to the terms of this contract.
